Salary Advance Agreement
This agreement is made between [Company] (the Company) and [Employee Name], [Position] (the Employee).
The Company advances to the Employee [Amount] against the Employee's wage. The amount is paid to the Employee on [Date Paid].
No interest, fee or other charge is payable on this amount: the Employee repays the amount received and nothing more.
The Employee repays the amount in 2 monthly instalments of [Instalment], deducted from the Employee's wage, starting with the wage for [First Month] and ending with the wage for [Last Month].
The Employee's monthly wage at the date of this agreement is [Monthly Wage], the basic wage plus allowances.
By signing this agreement, the Employee gives written consent to these deductions from the wage, as Article 25(1)(a) of Federal Decree-Law No. 33 of 2021 (the Decree-Law) requires for the repayment of a loan granted to the worker.
The deductions are made within the limits of Article 25 of the Decree-Law: where there are several reasons for deduction, the total deducted from the wage may not exceed 50% of the wage (Article 25(2)).
If the employment ends before the amount is repaid in full, the Company may deduct the outstanding balance from the Employee's end-of-service entitlements, as Article 51(7) of the Decree-Law and Article 29(1)(a) of Cabinet Resolution No. 1 of 2022 allow. Any balance that remains after that is settled in accordance with the Decree-Law.
Each party keeps a signed copy of this agreement.
