The contract registered with MOHRE
The wage is a term of the employment contract. Federal Decree-Law No. 33 of 2021, Article 22(1): “The amount or type of wage shall be specified in the employment contract.” Cabinet Resolution No. 1 of 2022, Article 10(1) lists what the contract contains, including the job and “the wage agreed upon including the benefits and allowances”. The contract is written on the forms the Ministry approves (Article 8).
MOHRE changes a registered contract through its “Modification of Work Permits / Employment Contracts” service, which asks for an “Employment contract approved by the Ministry, signed by both the employer and employee”. The letter therefore says that the change will be reflected in the employment contract registered with MOHRE. It does not register anything itself.
Increases and promotions only
The page generates the letter only when the basic salary and the total stay the same or go up. The UAE Government portal u.ae states that “the employer is not allowed to alter or replace any provisions of the offer letter unless the employee consents to it, and such changes are within the scope of law.” A lower wage therefore needs the employee’s agreement and an amended contract, and a letter from the employer cannot replace them. A promotion without a change in salary is accepted.
Frequently Asked Questions
Does a salary increase need a new contract in the UAE?
The wage is stated in the employment contract (Article 22(1) of Federal Decree-Law No. 33 of 2021), so the contract registered with MOHRE should be updated to show the new salary. The letter says so.
Can this letter reduce an employee’s salary?
No. It records increases and promotions only. A reduction needs the employee’s agreement and an amended contract signed by both parties.
