How a MOHRE Labour Complaint Works
Under Article 54(1) of Federal Decree-Law No. 33 of 2021, the Labour Law, employers, employees and their beneficiaries may dispute any right arising from the employment relationship by a request to MOHRE, which reviews it and takes steps towards an amicable resolution.
MOHRE renders a final decision when the claim is not more than AED 50,000, or when a party does not comply with an amicable settlement decision, whatever the value (Article 54(2)). Either party may take that decision to the Court of Appeals within 15 working days of being notified of it (Article 54(3)). Other disputes that are not settled are referred to the competent court with a memorandum from MOHRE (Article 54(4)).
Labour claims of workers or their heirs up to AED 100,000 are exempt from court fees at all stages (Article 55(1)). MOHRE’s service card lists no fee for registering the complaint.
A termination because the worker made a serious complaint to MOHRE, or filed a lawsuit, whose validity is proven, is unlawful (Article 47(1)).
Time limits differ between official texts. MOHRE’s guide for workers says a complaint can be made within 30 days of the employer’s breach. For a court claim, Article 54(9) as replaced by Federal Decree-Law No. 9 of 2024 counts 2 years from the end of the employment relationship; the texts published before it, including the English text MOHRE still publishes, count 1 year from the date the right became due.
